7 Scooter Rental Services DBA 7 Scooters

These Terms of Use (“Terms”) constitute a legally binding agreement between 7 Scooter Rental Services, operating under the brand name “7 Scooters”, having its registered office at Ruby Park, Park Street, Wakad, Pune – 411057, Maharashtra, India (“Company”, “we”, “our”, or “us”), and any person who accesses our website or avails our rental services (“Customer”, “User”, or “you”).

By accessing or using the website www.7scooters.in, or by renting a vehicle from us, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the website and our services.

1. Eligibility

  • You must be at least 18 years of age and must hold a valid Indian driver’s licence applicable to the class of two-wheeler being rented.
  • Only the Customer whose name appears on the Rental Agreement is authorised to operate the rented vehicle.
  • The Company may request supporting documentation, including but not limited to:
    • Aadhaar Card
    • Driving Licence (original)
    • Local or Permanent Address Proof
    • Company ID Card
    • Reference Contact Details

2. Acceptance of Terms

  • By booking, operating, or using a vehicle provided by the Company, you agree to comply with these Terms.
  • These Terms apply to all rental services, including petrol and electric two-wheelers, accessories, and any ancillary products provided by the Company.

3. Vehicle Condition and Delivery

  • The Customer acknowledges that the vehicle has been inspected, test-driven, and received in good working condition.
  • The Customer shall receive photocopies or soft copies of the vehicle’s documents.
  • Misrepresentation, falsification of documents, or failure to provide accurate information shall result in rejection or cancellation of the rental and may attract legal consequences.

4. Permitted Use and Restrictions

  • The rented vehicle shall be operated only by the Customer named in the Rental Agreement.
  • The Customer shall not take the vehicle outside the following geographic limits:
    • Pune Municipal Corporation (PMC)
    • Pimpri-Chinchwad Municipal Corporation (PCMC)
  • The Customer shall not exceed 100 kilometres per day unless expressly authorised in writing.
  • Overloading is strictly prohibited. The maximum permissible combined weight (rider + pillion + baggage) is 120 kilograms.
  • The vehicle shall not be used for:
    • any unlawful activities;
    • commercial carriage of goods;
    • racing, stunts, or reckless driving;
    • towing another vehicle;
    • subletting or lending to any third party.

5. Compliance with Law

  • The Customer must comply with all applicable traffic rules, RTO regulations, and safety obligations.
  • Any fines, penalties, challans, or legal notices issued during the rental period shall be the sole responsibility of the Customer.

6. Rental Period and Late Return

  • The Customer must return the vehicle on or before the Rental End Date and Time specified in the Rental Agreement.
  • Failure to return the vehicle on time shall result in a penalty of Rs. 500 per day.
  • If the vehicle is not returned within two (2) days of the Rental End Date, the Company may initiate:
    • a police complaint;
    • legal proceedings; and/or
    • recovery action for dues, damages, and losses.

7. Payment Terms

  • All payments made at the time of booking or at the time of issuance are strictly non-refundable.
  • Rental charges are calculated based on the tariff applicable at the time of booking.
  • The Company may modify its pricing structure at its sole discretion without prior notice.

8. Security Deposit

  • A refundable security deposit may be collected prior to issuing the vehicle.
  • The deposit shall be refunded only upon:
    • inspection of the returned vehicle;
    • verification of returned documents and accessories;
    • clearance of all outstanding payments, penalties, fines, or damages.
  • Deductions may be made in case of:
    • vehicle damage;
    • missing accessories or documents;
    • loss of helmet(s);
    • violation of these Terms;
    • excessive wear and tear;
    • outstanding challans or penalties.

9. Fuel, Battery and Consumables

  • Fuel expenses are the sole responsibility of the Customer.
  • For electric vehicles, the Customer shall not:
    • overcharge the battery;
    • use non-approved chargers;
    • mishandle or improperly store the charger or battery.
  • Customers must maintain recommended tyre air pressure.
  • If a tyre incurs five (5) or more punctures during the rental period, the Customer must replace the tyre at their own cost.

10. Damage, Loss, Theft and Liability

  • The Customer shall be fully liable for all damages to the vehicle, including but not limited to:
    • body damage (scratches, dents);
    • mechanical or electrical failures;
    • battery damage;
    • burnt wiring;
    • tyre or rim damage;
    • damage due to overloading or negligent use.
  • All repairs shall be carried out only through Company-approved garages.
  • The Customer shall not undertake repairs independently or through third-party garages.
  • In the event of theft, total loss, destruction, or fire:
    • the Customer shall immediately inform the Company; and
    • the Customer shall bear the entire market value of the vehicle, as determined by the Company, along with any consequential losses, including loss of business.
  • The Customer shall compensate the Company for all losses arising from breach of these Terms.

11. Insurance

  • Insurance coverage on vehicles is governed by the policy terms of the insurance service provider and/or applicable laws in force.
  • Insurance coverage may be limited, and the Customer remains liable for all damages not covered by the insurer.
  • Any applicable insurance claim must comply with the insurer’s requirements. Failure to do so may make the Customer fully liable for damages.

12. Tracking and Monitoring

  • Vehicles may be equipped with GPS or electronic tracking systems for safety, security, asset protection, or operational purposes.
  • The Customer expressly consents to reasonable monitoring of:
    • vehicle location (if applicable);
    • vehicle usage patterns;
    • odometer readings.
  • The Company shall not be liable for claims of infringement of privacy arising from such tracking measures.

13. Indemnification

The Customer agrees to indemnify, defend, and hold harmless the Company, its officers, employees, agents, and affiliates from all claims, liabilities, damages, injuries, losses, costs, and expenses arising from:

  • use or misuse of the vehicle;
  • accidents, injury, disability, or loss of life;
  • unlawful conduct or negligence;
  • third-party claims; and
  • breach of these Terms.

14. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for:

  • indirect, incidental, punitive, or consequential damages;
  • loss of profits or business interruption;
  • loss or damage to personal property;
  • delays, breakdowns, or service interruptions caused by external events.

15. Force Majeure

The Company shall not be liable for any delay or failure in performance caused by circumstances beyond its reasonable control, including natural disasters, pandemics, governmental orders, riots, strikes, labour disputes, or technical failures.

16. Intellectual Property

All content on the website, including but not limited to text, images, logos, design elements, and trademarks, is the exclusive property of the Company. Users shall not copy, reproduce, or commercially use any content without prior written permission.

17. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra.

18. Amendments

The Company reserves the right to update, revise, or modify these Terms at any time without prior notice. Continued use of the website or services constitutes acceptance of the revised Terms.
